II - TYPES OF THE INFORMATION IN POSSESSION OF THE ‘’PORT OF BAR’’ JSC BAR

1. Normative acts

– Statute of the Company and Rules of procedures of the Company Assembly and other internal acts;
– Collective Agreement;
– Tariff "Port of Bar" JSC
– General rules of operation in the Free Zone of the Port of Bar;
– Free Zone Tariff.
 

2. Public records

 Structured records of the employees (number of employees, qualification structure, educational background);
– Records of the international projects in which the Port participates in;
 Published tenders;
– Published public invitations and advertisements;
– ISPS-code.
 

3. Plans, reports, analyzes and other acts

 Business plan;
–  Report on cargoes handling;
 Periodical reports on participation in the international projects;
–  Internal training programs for employees.
 

4. Individual acts

–  Decision on expert commissions formation;
 Decision on working time.
 

5. Finance

 Business report on the first, second, third quarter;
– Annual Business reports;
 Audit findings;
 Documentation of the fixed assets.
 

6. Organizational, Board of directors and management structure

– Macro-organizational structure;
– Data on Board of directors structure;
– Data on management structure.
III - PROCEDURE OF ACCESS TO INFORMATION OBTAINING

1. Initiations of procedure

 The procedure for access to information should be initiated at the written or oral request of the person seeking access to information;
–  Written request for access to information is submitted directly on archive, by fax, electronic mail or by mail;
–  Oral request is submitted for the record to the authorized person;
– No fee is paid for access to information.
 

2. Request should contain::

– Basic information about the requested information;
– The way in which the access to information to be obtained;
– Information about applicant (name, surname and address of the physical entity or name and address of the legal entity) i.e. his representative, agent or proxy.
 

3. Way of exercising rights to access to information

 By direct insight into the original or a copy of the information with the authorized person in the ‘’Port of Bar’’ JSC Bar;
– By information transcribing from the applicant in the ‘’Port of Bar’’ JSC Bar;
– By submitting a copy of information to the applicant by the ‘’Port of Bar’’ JSC Bar, directly by mail or by electronic mail.
 

4. Operating on request and legal protection

 Upon the request for access to information, it is operated within 15 days from the day of the request submitting, except in case of protection of life and liberty of the entity, when it is operated within 48 hours upon the request;
–  Conclusions and solutions adopted by the ‘’Port of Bar’’ JSC upon the request for access to information are final and it can be appealed against them to the Agency for data protection and free access to information;
–   Access to information is realized within three working days from the day of decision submitting, by which the access is allowed, i.e. within five days from the day when the applicant has submitted proof of payment of the procedure costs, if defined by the decision.
 

5. Procedure costs

 The procedure costs are borne by the person requesting access to information;
– The costs can be fixed and variable;
– The fixed costs of procedure are related to the real costs in terms of copying, scanning and delivery of the requested information and they are defined by the Regulation on the reimbursement of the costs in procedure for access to information (Official Gazette of the Republic of Montenegro no. 02/2007);
– The variable costs are related to the information and activities which represent archival material or to the information from which it will be eventually removed the mark ‘’business secret’’, after the approval of the competent authority and they are defined by a separate act;
– The costs are paid prior to the decision execution;
– Persons with disabilities and person in condition of social need do not pay the costs;
– The costs are paid to the bank account of the Port of Bar JSC no 510-334-08 with Crnogorska komercijalna banka.
 

6. Authorized person

The person authorized to act upon the request for access to information is Chief of the Executive director cabinet and in case of absence of the authorized person, the Business secretary of the Executive director cabinet, e-mail:  kabinet@lukabar.me.

7. Termination

With the publication of this Guide, the Information Access Guide held by the ‘’Port of Bar’’ JSC from May 2013 ceases to be valid.

8. Guide publishing

This Guide will be published on the website of the “Port of Bar” JSC.
